Ferrari, in classic Ferrari style, declined to comment on the lawsuit or on what criteria buyers must meet in order to be chosen for its special-edition cars. In fact, Ferrari even has a clause in the sales contract of the LaFerrari Aperta which gives the company the right to buy back the car if the seller decides to pass it on within 18 months of its purchase.

Ferrari has been known in the past to immediately blacklist anybody it suspects of trying to make a profit off its cars, and anybody caught will never get anywhere near a new Ferrari ever again. Other manufacturers like Aston Martin use similar tactics, with the extra profit generated by the special editions funding the production of its regular models. While other marques like Porsche fund their halo cars from the sales of more mainstream models like SUVs, for Ferrari this would be an unacceptable dilution of its brand.

For limited-edition cars Ferrari generally handpicks its customers, taking them to its headquarters to get a first-hand look at plans for the upcoming model. The whole production series is usually sold out months before the public even knows about it, as was the case for the LaFerrari Aperta. Often, manufacturers will keep a list of around people who will get calls in advance asking them if they want in on the latest special edition.

Anybody not on the list will probably never know, and will likely have a hard time getting a foot in the door. Some now claim that Ferrari has created a dependency on its special edition cars, which is unsustainable in its current format if it wants to hit increasing sales targets.

There has been a feud between Ferrari and Lamborghini for decades and it rages on. If you want on a VIP list for a limited-edition Ferrari and you also own a Lambo you can forget about it. The colors pink, rose, and salmon are strictly forbidden. Additionally, all maintenance work must be performed by an authorized Ferrari dealer. If not the warranty is voided and you are placed on a list of those forbidden from purchasing a new Ferrari in the future. If you own a Ferrari you will be invited to exclusive Ferrari functions and events.

The expectation is to drink the Ferrari Kool-Aid at these functions, too. To get on a waiting list for a limited-edition Ferrari you must own at least four other Ferraris. The Ferrari blacklist is real and one way to get on it is to badmouth the brand as 50 Cent did recently.

Any car dealership will, of course, do a quick check to see if the buyer can actually afford to pay for the car. Ferrari, however, is much stricter than that. Not only do they want to know if you can pay for it, they also want to make sure only the right type of people are seen behind the wheel in one of their vehicles.

If Ferrari actually lets you buy one of their cars, you'll have to agree that you'll only take your car to their officially-approved repair shops if it breaks down or needs to undergo service. It may be more expensive, but if the company finds that you have been getting repairs done at your local garage, then your very expensive warranty will be void!

Older Ferraris shared a lot of components with Fiats and Alfa Romeos. For all we know, there might be some shared component to this day. They might be a lot cheaper since they're not official Ferrari parts, but forget about using those if you want to keep your warranty. Ferrari is having none of that!

The rules for Ferrari ownership are strict, especially so for special edition cars. Owners are not allowed to sell new cars within the first year of buying them from Ferrari. This is included in the contract to prevent people from buying limited edition Ferraris and then flipping them for a profit because of the increased demand. Anyone buying a brand new Ferrari from a dealership has to sign a contract — and it really is necessary to read all the small print!

For example, owners are told to let Ferrari know before they plan to sell their vehicle. They do this so they can decide if they want to buy the car back themselves in order to keep close control over who owns their vehicles. While owners of Ferrari cars are told to let the company know when they are selling their vehicles or are banned from selling limited edition vehicles entirely within the first year, Ferrari won't always buy back those cars. However, there are some special cars that absolutely have to be sold back to Ferrari, so that the company can control completely who owns their flagship cars.

Anyone who knows the history between these Italian supercar makers knows that there's a strong rivalry between them. They are constantly trying to outdo each other with new innovations, and they expect brand rivalry from their owners too.
